 Wesley Chapel Lawn Care Service LLC - Restrictions, Terms, and Liability Disclaimer

By hiring Wesley Chapel Lawn Care Service LLC or any of its affiliated companies, including Wesley Chapel Mulch Supply and Dale Landscaping, you voluntarily accept and agree to the following terms, conditions, and limitations:

1. COVID-19 and Health Responsibility: Wesley Chapel Lawn Care Service is not responsible for any sickness, virus, or COVID-19 transmission. By engaging our services, you understand that we may come into contact with surfaces such as fences, doors, or latches. It is your responsibility to sanitize these surfaces before or after our visit. We are committed to protecting our employees, but we cannot be held liable for any exposure. If you or anyone involved in the service has had a virus or illness in the last 2 days, please communicate by email and inform us immediately.

2. Weather-Related Delays and Service Adjustments: Weather conditions may delay services or force us to skip areas of the property. This does not affect your monthly pricing. In the event of a hurricane or tropical storm, we will do our best to complete services but may skip mowing if conditions are unsafe for our crew. We are not liable for weather-related damage or service delays.

3. Service Limitations:

• Basic Lawn Service: Does not include line trimming or edging of conservation areas, but this service can be added for an additional fee.
• Clumps of Grass: During the summer, grass clumps may form. We can attempt to reduce this by up to 60% for an additional charge.
• PVC Products in Sun: PVC or CPVC materials exposed to sunlight may degrade over time. Wesley Chapel Lawn Care Service is not liable for any damage to PVC materials left in the sun for over four hours. It is the responsibility of the property owner to maintain these materials, including regular waxing or painting.

4. Property Condition and Liability:

• Debris: We are not liable for damages caused by debris in the yard becoming a projectile during mowing. We recommend removing debris before our visit.
• Ruts and Mud: Wesley Chapel Lawn Care Service is not liable for ruts, mud, or damage caused by wet conditions or poor drainage. If you do not want us to mow in wet conditions, please inform us.
• Weed and Insect Transfer: We are not responsible for the transfer of weeds, pests, or diseases between properties or from our equipment.
• Plant and Shrubbery Damage: We are not responsible for any damage to plants, shrubs, or flowers, including damage caused by insect infestations, weeds, or chemicals.
• Fence and Gate Locks: We will secure gates upon leaving, but we are not liable for faulty gate locks or if a gate opens after our departure.

5. Equipment and Service Adjustments:

• Edging and Line Trimming: In some cases, we may opt to edge properties bi-weekly to maintain a clean, crisp edge. This may occur in both summer and winter.
• Sod and Grass Issues: We are not liable for damage caused by pests, disease, heat stress, or other external factors affecting your grass. If we notice an issue, we will do our best to communicate with you.

6. Pricing and Payment:

• Price Adjustments: We may adjust prices every two years due to increased costs, vendor price changes, inflation, or adjustments for new work conditions. Price changes will typically range from $5 to $40, depending on the circumstances. You will be notified in advance of any price changes.
• Additional Charges: If additional work is requested after the original estimate (such as new plants, renovations, or added services), the price may change.
• Late Payments: A $10 late fee will apply for overdue payments, which will increase with each month the payment remains unpaid. The client is responsible for any creditor fees or legal costs incurred due to late payments.

7. Non-Refundable Services and Purchases:

• Plants and Mulch: All plant or mulch purchases are final and non-refundable. There are no warranties for these products or the services provided.
• No Returns or Refunds: We do not offer refunds for any services provided or products purchased. All sales are final.

8. Liability Waiver: By engaging our services, you agree to hold Wesley Chapel Lawn Care Service LLC harmless for any damages, losses, illnesses, or injuries arising from the performance of our services, including but not limited to the transmission of viruses, damage to property, or health-related issues.

9. Privacy and Data Collection: By contacting or purchasing services from us, you consent to the collection and use of your personal data as described in our Privacy Policy. We may collect, store, and share your data as needed to provide our services and improve customer experience. By using our services, you acknowledge and accept these practices.  We collect personal data such as name, email address, phone number, and payment information, notes describing clients wishes and objections, interests, and other to provide our services to you and to ensure a smooth customer experience. We also collect information to send you promotions, updates, and special offers related to our services. Data will be held for as long as the company fees it is important to do so.  We may also take video or pictures when necessary.  Pictures are used to help describe, while video is to ensure oversight of our workforce in a security fashion. By using our website or accessing any of our services, you agree to the collection of this data, including the use of cookies, and the sharing of your information with our affiliated companies for service and promotional purposes.

10. Confidentiality: Protecting your personal data is of utmost importance to us. We take all necessary steps to ensure the security of your data. All collected data is stored securely and is used solely for business purposes related to providing and enhancing our services.  Your privacy is important to us. We take all reasonable steps to protect your personal data and ensure that it is stored securely. However, please be aware that the personal information we collect may be shared with affiliated companies and, in certain cases, sold to third parties for marketing and business purposes. By using this website or engaging with our services, you consent to the sharing of your data with our affiliated companies and other third-party partners for promotional and business purposes. This may include the sale of certain data for marketing or operational purposes. 11. Service Scheduling and Communication: Please note that if you wish to cancel or change the services scheduled, you must notify us in advance. We will attempt to provide services on the scheduled dates, but may skip areas if the weather or other conditions make it unsafe for our crew. We do not text and want clients to email. 

12. Miscellaneous:

• Gutter Downspouts: Please ensure gutter downspouts are clear and positioned 5-8 inches off the ground to avoid damage from line trimming equipment.
• Sod and Grass Care: We are not responsible for grass or sod affected by external factors such as pests, diseases, or improper irrigation.

13. Third-Party Vendor Payments:

Please be advised that any payments made to third-party vendors, service providers, or suppliers, which are outside of the scope of your payable invoice with Wesley Chapel Lawn Care Service LLC, are your sole responsibility. We are not liable for any transactions, issues, or disputes arising from payments to third-party vendors.

If you choose to engage with any external service providers or vendors for additional products, services, or materials not included in the invoiced work, the terms of payment, warranties, and any potential fees or charges are directly between you and the third party.

Wesley Chapel Lawn Care Service LLC is not responsible for any payments made outside of the invoiced amount for services rendered by our company, nor will we be responsible for any delays or issues that may arise as a result of these third-party transactions.

If you have questions or concerns regarding payments made to third-party vendors, please address them directly with the vendor in question.

14.  Any non check payment:

Please note that if payment is made via credit card or any non-check payment method, an additional labor and processing fee will be applied. This fee is necessary to cover the administrative costs associated with processing such payments.

To avoid these additional charges, we recommend using check, money order, or online bank as your payment method. These options do not incur the same processing fees and are preferred by our company.

If you choose to pay with a credit card, please be aware that the additional fee will be added to your total invoice prior to processing. We are not responsible for any issues related to credit card payments.

15,  Yard Preparation and Liability:

To ensure safe and efficient service, please ensure the following before our scheduled visit:

• Remove Dog/Animal Waste & Toys: Please pick up any dog or animal waste, toys, or other items from the yard. This helps us provide safe passage and avoid any obstacles that could affect our equipment or crew.
• Irrigation: To prevent mud tracks and minimize disruption, please ensure your irrigation system is turned off prior to our arrival. This will help avoid additional complications caused by wet or oversaturated ground, especially during or after natural weather events.
• Yard Clearance: Please ensure that the yard is clear of any items that could pose a risk to our machines or crew, such as toys, debris, or objects that could be damaged by the equipment or cause injury.

Liability Notice: Wesley Chapel Lawn Care Service is not liable for any damage, injury, or issues resulting from unremoved items in the yard, including but not limited to items that may cause ricochet or damage to equipment. It is the homeowner’s responsibility to ensure the yard is properly prepared before our arrival. If these preparations are not made, we are not responsible for any resulting issues.

If failure to prepare the yard becomes a recurring issue, we may need to adjust your service package to account for the added work required.

16. Liability for Tire Tracks:

Please note that Wesley Chapel Lawn Care Service is not liable for tire tracks left on concrete, pavers, or any hard surface during the course of our service. While we take care to minimize any impact, tire marks may occur, particularly in areas where the ground is wet or saturated. We recommend ensuring that any sensitive surfaces are clear or adequately protected prior to our arrival to avoid any unintended markings.
